Minister of Transport either misled or lied to Parliament about AirAsia’s debts!

Tuan Wee Choo Keong [ Wangsa Maju ] minta MENTERI PENGANGKUTAN menyatakan di bawah undang-undang apakah MAB dan MAS dibenarkan oleh Kementerian untuk memberikan kemudahan kredit melebihi RM110 juta dan RM85 juta kepada AirAsia, sebuah syarikat swasta dan apakah langkah-langkah yang telah diambil oleh MAB dan MAS untuk mendapatkan semula hutang-hutang tersebut daripada AirAsia.

Pemberian kredit oleh Malaysia Airports Holding (MAHB) kepada AirAsia adalah tertakluk kepada polisi kredit syarikat yang diluluskan oleh Lembaga Pengarahnya. Berdasarkan polisi kredit syarikat, tiada had ditetapkan untuk sebarang kemudahan kredit yang diberikan kepada syarikat-syarikat penerbangan. Walau bagaimanapun, AirAsia diberi tempoh kredit selama 30 hari dan caj faedah dikenakan ke atas pembayaran lewat sebanyak 1% sebulan.

Bagi Syarikat Penerbangan Malaysia (MAS) pula, kemudahan kredit yang diberikan kepada AirAsia adalah bagi tujuan perkhidmatan udara luar bandar (Rural Air Services – RAS) untuk memastikan pelaksanaan RAS berjalan lancer. Kredit yang diberi oleh MAS adalah dari segi “maintenance” pesawat FAX.

Bagi mendapatkan semula hutang-hutang tersebut daripada AirAsia, MAS dan MAHB sedangan mengadakan perbincangan dengan AirAsia dan Kementerian Kewangan.

Note:

The Minister of Transport (MOT) was deliberately not answering the second part of the question i.e. what actions have been taken or to be taken by MAHB and MAS to recover the said debts of RM110 million and RM85 million from AirAsia. The MOT’s reply that “… MAS dan MAHB sedangan mengadakan perbincangan dengan AirAsia dan Kementerian Kewangan” was most ridiculous and an insult to the intelligence of the Malaysian public.

AirAsia is a private company listed in the Bursa Saham KL. Why was the Minister of Finance involved with debts owed by AirAsia, a private company, since year 2002? Why was there no negotiation before the last Parliamentary sitting in May 2008 or before I questioned about these debts, which have been owed since 2002!. The MOT’s reply seems to suggest that the Minister of Finance has an interest in AirAsia. If this is so, then the Minister of Finance should announce his interests.

Further, AirAsia had been quoted in the press to have said that it only owed MAHB the sum of about RM60 million and not as announced by MOT. Under the circumstances, MOT must have lied in Parliament when he told Parliament that AirAsia owed MAHB about RM110 million. The MOT must be censured for telling a white lie in Parliament or misleading Parliament.

In any event, AirAsia should pay up the sum of RM60 million first before going through with the so-called “negotiations” with the Minister of Finance.

This matter will be pursued to the fullest in parliament because the MOT must not lie or mislead Parliament in the way the MOT did.

Minister of Federal Territory’s reply to my question on road-widening project of Jalan Genting Kelang.

minta MENTERI WILAYAH PERSEKUTUAN menyatakan kos keseluruhan untuk projek membesarkan jalan “JALAN GENTING KELANG DARI PERSIMPANGAN JALAN AIR PANAS KE PERSIMPANGAN JALAN 1/27A” di Wangsa Maju dan kenapakah Kementerian tidak mengadakan “Tender Terbuka” sebelum memberikan projek tersebut kepada Mentari Contracting (M) Sdn Bhd.

Untuk makluman Yang Berhormat bagi Wangsa Maju kos keseluruhan bagi projek “Jalan Genting Kelang Dari Persimpangan Jalan Air Panas Ke Persimpangan Jalan 1/27A” di Wangasa Maju adalah RM40 juta termasuk kos pengambilan tanah berjumlah RM20 juta. Jumlah peruntukan yang disediakan untuk perbelanjaan bagi tahun 2008 adalah sebanyak RM25 juta.

Pelawaan tawaran projek ini telah dibuat secara tender terbuka kepada kontraktor-kontraktor Kelas A melalui iklan-iklan yang disiarkan pada 10 April 2007 di dalam akbar Utusan Malaysia, Berita Harian dan laman web DBKL.

Penilaian tawaran telah dibuat diperingkat DBKL dan Lembaga Perolehan ‘A’ Kementerian Persekutuan bagi memilih kontraktor berdasarkan aspek-aspek kesempurnaan tender, tender dan kewangan dan juga komersial.

Tetuan Mentari Contracting (M) Sdn Bhd telah menepati aspek-aspek yang ditetapkan dan telah ditawarkan kontrak dengan nilai kontrack RM18,966,428-00 serta tempoh siap projek selama 74 minggu. Kerja pembinaan projek telah bermula pada 18 Disember 2007 dan dijanka siap pada 18 Mac 2009. Kerja pembinaan adalah mengikut jadual dengan mengambil kira permasalahan pengambilan tanah dan juga pengalihan utiliti di tapak.

Tuan Wee Choo Keong [ Wangsa Maju ] minta MENTERI DALAM NEGERI menyatakan apakah tindakan yang bakal diambil terhadap warga Singapura yang sudah bertahun-tahun memasuki Malaysia menggunakan Pas Lawatan Sosial bulanan dan dalam masa yang sama mereka bekerja atau membuka perniagaan di sini dan kekal tinggal di Malaysia dan apakah tindakan yang akan diambil terhadap penyalah gunaan Pas Lawatan Sosial oleh warga Singapura tersebut.

Terima kasih saya ucapkan kepada Yang Berhormat dari Wangsa Maju yang mengemukakan pertanyaan tersebut.

Untuk makluman Ahli Yang Berhormat, berdasarkan statistic kemasukan warganegara asing ke Malaysia bagi tempoh 01 Januari 2008 hingga 30 April 2008 seramai 6,617,881 orang telah memasuki Malaysia melalui pintu-pintu masuk yang telah diwaratakan. Daripada jumlah tersebut, jumlah kemasukan warganegara asing daripada Singapura adalah seramai 3,553,595 orang yang menyumbang kepada 53% daripada jumlah kemasukan. Mereka ini masuk ke Malaysia secara teratur dan mepunyai dokumen perjalanan dan pas yang sah berkaitan bagi mahupun berkerja di Malaysia.

Oleh yang demikian, seseorang warga asing yang memasuki Malaysia haruslah mematuhi syarta-syarat yang ditetapkan dalam Akta Pasport 1966 atau Akta Imigresen 1959/63 serta peraturan-peraturan imigresen yang berkaitan. Dalam hubungan ini, bagi membendung tindakan warga Singapura yang memasuki Malaysia dengan menggunakan Pas Lawatan Sosial untuk berkerja atau membuka perniagaan di Malaysia, Kerajaan telah mengambil beberapa langkah seperikut berikut:-

i) Mengadakan operasi penguatkuasaan bersama antara JIM, RELA dan PDRM secara berterusan untuk mengesan, menagkap, mendakwa dan mengusir warganegara asing yang melangar syarta-syarat dan peraturan di bawah Akta Imigresen 1959/63 dan Peraturan Imigresen 1962;

ii) Pemeriksaan rawak terhadap setiap warga asing yang memasuki Malaysia bagi memastikan bahawa mereka mempunyai duit yagn mencukupi untuk tempoh berada di Negara ini;

iii) Memperkenalkan sistem biometric bagi memastikan cap cari semua perkerja asing diambil sebelum mereka dibenarkan masuk untuk berkerja di Malaysia;

iv) Mengadakan taklimat/dialog dengan masyarakat dan persatuan majikan bagi menjelaskan tenatang undang-undang Imigresen yang harus dipatuhi;

v) Mengeluarkan ‘i-card’ untuk semua pelajar dan pekerja asing supaya pihak penguatkuasa mudah mengenal pasti pelajar dan pekerja asing tulen; dan

vi) Memperkenalkan Malaysia Enforcement Immigration System (MEIS) bagi memudahkan tugas-tugas penguatkuasaan melalui pengesahan dokumen perjalanan warga asing adalah tulen berdasarkan semakin dengan pusat pangkalan data JIM. Mekanisme ini juga diyakini akan mampu membantu pihak penguatkuasa melakukan operasi di lokasi-lokasi tempat mereka berkerja seperti di tapak pembinaan dan kilang.

Bagi tempoh 1 Januari 2008 hingga 30 April 2008 sebanyak 2,050 buah operasi penguatkuasaaan dan Berjaya menangkap seramai 20,098 orang PATI kerana melakukan berbagai kesalahan imigresen. Daripada, jumlah tangkapan tersebut, seramai 5 orang warga Singapura ditangkap kerana melakukan kesalahan tinggal melebihi masa (tempoh) yang dibenarkan (Kesalahan di bawah seksyen 15 (1) ( c ) Akta Imigresen 1959/63 dan menyalahgunakan Pas Lawatan/Permit Kerja yang dikeluarkan (Kesalahan di bawah Peraturan 39 (b) Peraturan-Peraturan Imigresen 1963.)

1. YB Tuan Wee Choo Keong [Wangsa Maju] asks the Minister of Home Affairs to state what are the measures the police force has taken or to be taken in the future in order to bring down crime rate in Wangsa Maju and elsewhere in Wilayah Persekutuan?

YB Tuan Wee Choo Keong [Wangsa Maju] asks the Minister of Transport to state on under what provision of the laws that MAB and MAS were allowed to grant credit facilities totaling more than RM110 million and RM85 million respectively to AirAsia, a private company? The Minister to also state what are the detailed actions that have been taken or to be taken by MAB and MAS to recover the said debts from AirAsia.

YB Tuan Wee Choo Keong [Wangsa Maju] asks the Minister of Education to state when did the Ministry approve the setting up and building of Sekolah Rendah Jenis Kebangsaan Cina (SRJKC) in Wangsa Maju area and when the construction works of this SRJKC will commence? Please provide the exact date of commencement and cost of constructions.

YB Tuan Wee Choo Keong [Wangsa Maju] asks the Minister of Foreign Affairs to state did our legal team informed the foreign legal experts that the picture of Pulau Batu Puteh to be tendered before ICJ was in fact taken from a blog (internet), the total professional fees paid to the foreign legal experts and total expenses for the whole Malaysian supporting legal team including professors and others, and provide the name of the firm of local solicitors involved in the case.

8. YB Tuan Wee Choo Keong [Wangsa Maju] asks the Prime Minister to state whether it is the policy of the Federal Government that the chairman of all companies (like MAB, Sepang International Circuit and others) where the Ministry of Finance has major interests, must be an UMNO member and does this mean that other Malaysians cannot hold such position in these companies even if he is a Bumiputra with different political thinking?

9. YB Tuan Wee Choo Keong [Wangsa Maju] asks the Minister of Foreign Affairs to state in February 2008 what was the total donations handed over by the newspapers to “Tabung Bencana Kementerian Luar Negeri” to help the victims of Blizzard Disaster in China and also whether the donations collected together with the pledged of RM1 million by the Prime Minister have been sent to the China Embassy. If sent when, if not why not.

10. YB Tuan Wee Choo Keong [Wangsa Maju] asks the Minister of Law to state whether the Government intends to order an investigation into the allegation of improprieties of a sitting Court of Appeal Judge, which evidence was tendered before the Royal Commission of Inquiry On Lingam Video Clip. If not, why not.

1. YB Tuan Wee Choo Keong [Wangsa Maju] asks the Minister of Finance to state why AMERICAN INTERNATIONAL ASSURRANCE CO LTD [AIA], the only 100% foreign owned insurance company, operating in Malaysia for many year without being locally incorporated, and it has just changed its name to American International Assurance Bhd, and to state who is its local partner and whether the local partner has fully paid for all their shares.

2. YB Tuan Wee Choo Keong [Wangsa Maju] asks the Prime Minister to state whether the 4 Proclamations of Emergency (declared in 1964 as a result of confrontation with Indonesia, 1966 in Sarawak following the constitutional stand off, 1969 after the My 13 riot, and 1977 in Kelantan following a political crisis), which are all still in force, will be revoked as Malaysians are living in peace. If not, please state why not.

YB Tuan Wee Choo Keong [Wangsa Maju] asks the Minister of Health to state whether the Government has taken steps to fully implement all the guidelines and condition set by WHO’s Framework Convention for Tobacco Control especially on the total ban of cigarette advertisement in any form, on cigarette companies sending out promoters to promote cigarettes in public places and display of cigarettes at the points of sale (e.g. mamak stalls & coffee shops). If not, why not.

YB Tuan Wee Choo Keong [Wangsa Maju] asks the Minister of Domestic Trade and Consumer Affairs to state how the government proposes to control inflation and price increases of other goods and services and at the same time maintain the present price of petrol, and why the ban on selling of petrol was not applicable to foreigners was not applicable to Singaporeans.
